Click here for a listing of Agricultural Actions.  This Department is responsible for:
• Enforcing license requirements for pest control companies and individuals
• Registration of businesses engaged in pest control for hire
• Evaluating and issuing restricted materials permits
• Monitoring sales of pesticides by licensed pesticide dealers
• Inspecting pesticide applications to ensure worker health and safety standards and proper pesticide application procedures are followed
• Investigation of pesticide related incidents
• Reporting of pesticides

The California Department of Pesticide Regulation delegates to the Department of Agriculture, Weights & Measures the duties of pesticide regulation within the County.
The authority for enforcing the Agricultural pest control laws and regulations can be found in the California Food and Agricultural Code.

Categories of violations are:
Worker Health & Safety - involves personal protective equipment or violations that endanger worker health and safety
Health Related - involves actual proved health consequences
Regulatory - licensing, registration, notifications, paperwork violations
Restricted Materials Permits - Any violation having to do with a RMP
Label Conflict - violations of the label

The following is a list of administrative civil penalties levied against agricultural businesses and individuals within the last two years. These cases have been fully adjudicated; meaning due process has been afforded by the opportunity for a hearing, appeal to the California Department of Pesticide Regulation, and further appeal to Superior Court. All appeal rights have been exhausted before cases appear on this web page.

Please be advised that penalties are mandated by regulation to be levied for a variety of violations. Violations are categorized as Class A (serious), Class B (moderate) and Class C (minor). More information regarding specific violations can be obtained via a public records request by e-mailing Tina.Thomas@sdcounty.ca.gov.

The most common agricultural pesticide violations (summarized) are:
1. Failure to ensure personal protective equipment, required by regulation, is worn by employees handling pesticides
2. Failure to post emergency medical care information for employees handling pesticide
3. Failure to use all personal protective equipment required by the pesticide label
4. Failure to follow pesticide label requirements regarding site, rate, or concentration
5. Failure to have a complete copy of the pesticide label available at the use site
6. Failure to label service containers with pesticide name, signal word, and the owner’s name and address
7. Failure to provide pesticide training for employees handling pesticides
8. Failure to use pesticides in a careful and effective manner
9. Failure of a licensed pest control business to register in San Diego County
10. Failure to identify pest control equipment, usually a truck, with company name

The California Structural Pest Control Board delegates to the Department of Agriculture, Weights & Measures the duties of pesticide regulation within the County.  The authority for enforcing the Structural pest control laws and regulations can be found in the Business and Professions Code.

1. Failure to post emergency medical care information for employees handling pesticide
2. Failure to ensure personal protective equipment, required by regulation, is worn by employees handling pesticides
3. Failure to keep pesticides attended or locked up where they are not a hazard to persons or animals
4. Failure to use pesticides in a careful and effective manner
5. Failure to identify pest control equipment, usually a truck, with company name
6. Failure to follow pesticide label requirements regarding site, rate, or concentration
7. Failure to have a complete copy of the pesticide label available at the use site
8. Failure to use all personal protective equipment required by the pesticide label
9. Failure to label service containers with pesticide name, signal word, and the owner’s name and address
10. Failure to secure pesticide containers during transport, or transporting pesticides in the same compartment with persons, food, or feed
