WALMART
AWM inspectors, along with weights and measures officials throughout the state, help bring evidence to the San Diego County District Attorney and California Attorney General in a four-year investigation of Wal-Mart stores that resulted in a $1.4 million judgment for overcharging consumers on items scanned at the check-out counters.
On November 24, 2008, Wal-Mart, without admitting wrongdoing, agreed to entry of a judgment that includes the payment of $1.2 million in civil penalties, $190,621 in costs to 30 weights and measures agencies and prosecutors’ offices, and $50,000 to a Consumer Protection Prosecution Trust Fund. The case was filed jointly by the San Diego County District Attorney’s Office and the California Attorney’s General Office in San Diego County Superior Court. The judgment prohibits Wal-Mart from charging an amount greater than the currently-advertised price for items in the future and requires every Wal-Mart store in California to maintain a “Get It Free” program for four years. Customers who are overcharged for an item which costs $3 or less will get that item for free. If the item costs more than $3, they item will be reduced by $3. A sign informing consumers of the program must be posted at every check-out stand.
Wal-Mart operates over 4000 stores nationwide with 20 being in San Diego County. AWM will receive over $14,000 in investigative cost recovery.
KRAGEN AUTO PARTS
On October 28, 2008, without admitting wrongdoing, CSK Auto, Inc., which does business in California as Kragen Auto Parts, consented to entry of a judgment in a civil case that includes the payment of more than $665,000 in civil penalties, costs, and restitution and injunctive provisions to ensure future compliance. The stipulated judgment, which was filed in San Bernardino County Superior Court, requires CSK to implement additional audit and price accuracy procedures in its California stores for a five year period to ensure compliance with pricing accuracy requirements. CSK must also implement a Scan-Right Guarantee to compensate consumers when they find they have been charged more than the lowest advertised or posted price. Signs explaining the guarantee will be posted in all California Kragen stores. Civil action was brought against CSK when evidence of overcharging customers at the check stand was gathered by Weights and Measures Officials in San Diego County, the State Division of Measurement Standards, and the district attorneys of San Bernardino, Santa Clara and Santa Cruz.
CSK Auto operates over 1,300 stores in 22 states. Kragen Auto Parts has over 500 stores in California with 36 being in San Diego County. AWM will receive over $13,000 in investigative cost recovery.

TARGET
On October 22, 2008, Target Corporation, without admitting wrongdoing, agreed to entry of a judgment that includes the payment of more than $1.7 million in civil penalties, costs, restitution and injunctive provisions to ensure future compliance. The judgment, filed in Contra Costa County, requires that Target implement additional audit and price accuracy procedures in its California stores for four years to ensure compliance with pricing requirements. Civil action was brought against Target after evidence of overcharging consumers for some of their products was presented by AWM weights and measures inspectors along with officials from the State Division of Measurement Standards and the district attorneys of Sonoma, Marin, Contra Costa, Fresno and Santa Cruz counties.
Target operates 1,685 stores in 48 states. 243 stores are in California with 13 being in San Diego County. AWM will receive over $8,000 in investigative cost recovery.

TOYS 'R' US
During a coordinated state-wide investigation, San Diego County Weights and Measures Inspectors teamed up with local and state law enforcement agencies to bring evidence in a consumer protection civil lawsuit. The District Attorney's Office of Santa Cruz and Marin County filed the case and on July 12, 2007, Toys R Us agreed to settle the lawsuit alleging that consumers were overcharged on items that were scanned in its California stores.
Without admitting wrongdoing, Toys R Us consented to injunctive provisions and payment of $300,000 in civil penalties, costs and restitution. The County of San Diego , Department of Agriculture, Weights and Measures spent about 45 hours on this investigation and is scheduled for cost reimbursement of over $3,000.

AUTOZONE
On June 1, 2007, AutoZone, Inc. agreed to settle a civil environmental and consumer protection lawsuit alleging that consumers were overcharged on items that were scanned in its California stores, including San Diego . In addition, AutoZone violated laws regarding storage and disposal of hazardous waste. AutoZone will pay $1 million in penalties, $300,000 in investigative cost reimbursement and will contribute $200,000 to environmental training programs for a total of $1.5 million. They were also required to administer a pricing accuracy program to avoid paying an additional $300,000 in penalties.
The San Diego County District Attorney's Office joined the California Attorney General and the District Attorney Offices of San Bernardino , Monterey and San Joaquin in this enforcement action.
San Diego County's Department of Agriculture, Weights and Measures joined the States Division of Measurement Standards and several other counties to bring evidence of the scanner price accuracy violations.
AutoZone has over 400 stores in California , 39 of which are located in San Diego County .

BASKIN-ROBBINS
On May 15, 2007, Baskin-Robbins Ice Cream Store agreed to settle a consumer protection lawsuit by paying $491,164 in penalties and investigative costs. The lawsuit was handled by San Diego District Attorney's Office in conjunction with the California Attorney General's Office. Prosecutors alleged that Baskin-Robbins' franchisees, throughout the State of California, advertised hand-packed ice cream in pint sizes but delivered containers that were not full, in violation of state laws.
The violations were discovered by Weights and Measures officials in San Diego County and 28 other counties who performed inspections at 188 locations under the direction of the California Department of Food and Agriculture, Division of Measurement Standards. Inspectors purchased 416 containers and found 343 (83%) of the hand-packed pints were about 4 ounces short on volume.
Baskin-Robbins has over 2,700 locations in the U.S. and 31 locations in San Diego County.

LONGS DRUG STORES
On April 12, 2007, Longs Drugs Stores California, Inc. agreed to pay $1 million in a consumer protection lawsuit that alleged scanner price overcharges in its California stores, including San Diego . Longs will pay $800,000 in penalties, $105,000 in investigative cost reimbursement, and $95,000 in restitution. The restitution will be directed to two state trust funds for use in investigating consumer protection cases. They were also required to administer a pricing accuracy program which began in January 2006 and continues through 2008. It provides customers with free or discounted items if they are overcharged.
San Diego County's Department of Agriculture, Weights and Measures joined the States Division of Measurement Standards and several other counties to bring evidence of scanner price accuracy violations to the attention of the Counties of Santa Barbara, Santa Clara, Marin, and Sonoma District Attorney's Office, and the City of San Diego City Attorney's Office, who established themselves as lead agencies in this investigation on behalf of the People of the State of California.
Longs has over 400 stores in California , 43 of which are located in San Diego County.

RADIOSHACK
On February 14, 2007, RadioShack, was ordered to pay $569,763 in penalties and reimbursements as a result of a civil settlement regarding scanner overcharge violations throughout California . RadioShack has been ordered to initiate a five-year program in each of its California stores to correct shelf and inaccurate scanner prices. Further, if a customer is overcharged, RadioShack agreed to give the customer that item for free if the item is less than $3. If the price is greater than $3, RadioShack will give the customer $3 off the lowest price advertised.
San Diego County's Weights and Measures inspectors brought evidence of scanner price accuracy violations to the attention of the County of San Diego District Attorney's Office, and established itself as a lead agency in this investigation on behalf of the People of the State of California . Ten weights and measures departments participated in the investigation.
RadioShack has 698 stores in California , 41 of which are located in San Diego County . Inspectors conducted 282 inspections at 186 stores and documented overcharges averaging $2 per item on about 650 items.
Every RadioShack store must inform customers of this policy by posting a sign at each checkout stand with the following:
"IF AN ITEM SCANS AT A PRICE HIGHER THAN THE SHELF LABEL PRICE OR STORE SIGN PRICE, WE WILL CORRECT THE ERROR AND DEDUCT $3.00 FROM THE LOWEST IN-STORE PRICE OF ONE SUCH ITEM. IF THE LOWEST IN-STORE PRICE IS $3.00 OR LESS, YOU WILL RECEIVE ONE SUCH ITEM FOR FREE."

SMART & FINAL
In October 11, 2006 Smart & Final, Inc. was ordered to pay $437,500 in penalties and reimbursements as a result of a civil settlement regarding scanner overcharge violations throughout California . Smart & Final has been ordered to initiate a three-year program in each of its California stores to correct shelf and inaccurate scanner prices. Further, Smart & Final agreed to make direct restitution by issuing a coupon with a value of $3.00 to each of its 1.2 million Advantage card holders.
San Diego County's Department of Agriculture, Weights and Measures joined the States Division of Measurement Standards and 17 other counties to bring evidence of scanner price accuracy violations to the attention of the Counties of Santa Barbara, Solano and Santa Clara District Attorney's Office, and the City of San Diego City Attorney's Office, who established themselves as a lead agencies in this investigation on behalf of the People of the State of California.
Smart & Final has 180 stores in California , 14 of which are located in San Diego County . Inspectors conducted 40 inspections at various locations.
