San Diego County Flood Control District Filed Communication

FLOOD 1. SUBJECT: Vacation of Flowage Easement - Lori Mar Court in Spring Valley - Green

(Supv. Dist: 2 )

OVERVIEW:

On December 12, 1991, the San Diego County Flood Control District acquired an easement for flowage purposes through private property located on Lori Mar Court in Spring Valley. The easement is not needed for district purposes because a drainage channel on an adjacent property was recently widened. The easement affects three parcels, two of which have improvements. The third parcel is unimproved and the owner, Mr. Raymond Green, would like to develop the parcel.

The Board of Directors of the San Diego County Flood Control District is requested to approve a Resolution vacating and abandoning the easement. Approval of the proposed vacation will allow Mr. Green to develop his property. By taking this action, the easement will be removed from the other two parcels as well.

FISCAL IMPACT:

There is no cost to the County as a result of this request. The property owner seeking approval of the easement vacation will pay the cost of processing the required documents and County staff expenses.

RECOMMENDATION:

CHIEF ADMINISTRATIVE OFFICER:

1. Find, in accordance with Section 15061(b)(3) of the State of California Environmental Quality Act Guidelines, that it can be seen with certainty that there is no possibility that the following action will have a significant effect on the environment.

2. Adopt the Resolution Vacating and Abandoning Flowage Easements encumbering Assessor's Parcel Nos. 504-023-34, 35, 36.

3. Direct the Clerk of the Board to record the Resolution Vacating and Abandoning Flowage Easements.

ACTION:

ON MOTION of Director Horn, seconded by Director Slater, the Board of Directors of the San Diego County Flood Control District took action as recommended, on Consent.

AYES: Cox, Jacob, Slater, Roberts, Horn

There being no further business, the Board adjourned at 3:50 p.m.
