Meeting was called to order at 9:16 a.m.

ON MOTION of Member Horn, seconded by Member Jacob, the Members of the Air Pollution Control Board approved the minutes for the meeting of June 17, 1998.

On September 26, 1995 (APCB 2), the Board approved Vehicle Registration Fee funding ($617,500) for a catalytic converter retrofit program proposed by Neutronics Enterprises. The program retrofits 1975-1980 cars with a catalytic converter system that greatly reduces vehicle emissions. The program is only operating at 30 percent of the projected rate. To date, approximately 300 vehicles have been retrofitted. Recent customer surveys have consistently given the highest ratings to this program. Thirty percent of respondents suggested the program should be advertised more. Therefore, it is recommended that $50,000 of funding approved for this program be transferred to the Nelson Communication Group (Nelson) to implement a targeted program marketing effort. Nelson is the current contractor for the District's motor vehicle education and outreach efforts.
The recommended action will not affect the current District budget or costs.
This proposal will not have a significant impact on the local business community.
1. Authorize the transfer of funds in the amount of $50,000 from Contract No. 42740 (Neutronics Enterprises) to Contract No. 43754 (Nelson Communications Group) for marketing the catalytic converter retrofit program.
2. Authorize the Deputy Director of General Services to amend each contract accordingly.

On April 24, 1996 (APCB 2), the Board accepted a $50,000 Clean Cities grant from the California Energy Commission (Commission) and authorized $50,000 in matching vehicle registration funds for a Zero Emission Vehicle (ZEV) Demonstration Program administered by the District. The demonstration program provided a $5,000 per-vehicle incentive for purchasing or leasing 20 qualifying ZEVs. All 20 incentives have been used. On October 22, 1997 (APCB 22), the Board accepted an additional $50,000 Clean Cities grant from the Commission and authorized $50,000 in matching funds from vehicle registration funds previously allocated for a compressed natural gas (CNG) and electric vehicle incentive program administered by San Diego Gas & Electric (SDG&E). This program provided an additional 20 ZEV incentives. To date, 10 have been used.
Based upon demand and the introduction of several new ZEV models, the District applied for and received another $100,000 Clean Cities grant to provide ZEV incentives, subject to Board acceptance of the grant and authorization of $100,000 in local matching funds. The District recommends accepting the grant and providing the match with vehicle registration funds previously allocated to SDG&E for CNG vehicle and ZEV incentives, making incentives available for an additional 20 ZEVs.
Additionally, the District, in collaboration with SDG&E, EV Media, General Motors, Saturn
Dealers and the San Diego County Office of Education applied for and received a grant in the amount of $45,000 from the Commission and the Air Resources Board (ARB) to fund a ZEV education program, subject to Board acceptance of the grant and authorization of $5,000 in matching funds. This program is designed to increase awareness among local educators, students and their families of the adverse impacts of air pollution and the role low-emission vehicles play in cleaning the air. SDG&E proposed, and the District concurs and recommends, vehicle registration funds previously allocated to SDG&E be used to match the grant, adding a $45,000 education component to the existing ZEV incentive program. This program will be implemented and administered by SDG&E. The other participating agencies will contribute a total of $155,963 in cash and in-kind support for the program.
The recommended action will not affect the current District budget or costs.

1. Authorize the Deputy Director of General Services to amend SDG&E Contract Number 42835 to earmark $100,000 in matching funds to provide a $100,000 Clean Cities Zero Emission Vehicle Demonstration Program grant from the Commission and to provide $5,000 in matching incentive funds to obtain a $45,000 Commission and ARB grant for a ZEV Education Program to be implemented and administered by SDG&E in accordance with Commission-approved grant provisions.
2. Authorize the Air Pollution Control Officer to execute an amendment to the Commission's Clean Cities Zero Emission Vehicle Demonstration Program Contract Number 500-96-003 for an additional $100,000 and to execute agreements with the Commission and ARB totaling $45,000 for the ZEV Education Program. (County Contract No. 73550-R & 73456-R)
3. Establish appropriations based on unanticipated revenue from the Commission in the amount of $100,000 for the Clean Cities Zero Emission Vehicle Demonstration Program and from the Commission and ARB in the amount of $45,000 for the ZEV Education Program.

Pursuant to federal law, on March 7, 1995 (APCB 2), the Board adopted a transportation conformity State Implementation Plan (SIP) revision containing two parts. The first is a Memorandum of Agreement (MOA) specifying mandated criteria and procedures, including an interagency consultation process for early review of key transportation planning documents. The second is Rule 1502 (Conformity of Transportation Plans, Programs, and Projects) requiring all agencies participating in the conformity process to execute the MOA.
Subsequent to Board adoption, Environmental Protection Agency (EPA) amended the federal rule to clarify regulatory language, eliminate duplication and simplify requirements. The District is required to revise the local procedures to reflect these amendments and submit them to EPA by August 15, 1998.
Additionally, EPA has suggested the MOA be replaced with a procedures document adopted by both the Board and SANDAG. EPA has stated continued use of the MOA will require the signatures of all transit agencies and local jurisdictions that are current or potential future recipients of federal funds (every city and the County). Consequently, the MOA has been reformatted into a procedures document. The MOA stakeholders, including SANDAG, were consulted and have agreed to the format change. The procedures format eliminates the need for signatures and therefore allows Rule 1502 to be repealed. Pursuant to EPA direction, SANDAG Board adoption is scheduled for July 24, 1998.
A public workshop was held on May 14, 1998. The Workshop Report is included as Submitted Attachment III.
There is no fiscal impact associated with these recommendations.

1. Adopt the Resolution adopting the San Diego Transportation Conformity Procedures, repealing Rule 1502 - Conformity of Transportation Plans, Programs and Projects, and terminating the associated Memorandum of Agreement, and make appropriate findings:
(i) of necessity, authority, clarity, consistency, non-duplication and reference as required by Section 40727 of the State Health and Safety Code;
(ii) that an assessment of the socioeconomic impact of the proposed San Diego Transportation
Conformity Procedures is not required by Section 40728.5 of the State Health and Safety Code because the repeal of Rule 1502 and adoption of the San Diego Transportation Conformity Procedures will not significantly affect air quality or emissions limitations; and
(iii) that it is certain there is no possibility that the repeal of Rule 1502, terminating the associated MOA, and the adoption of the San Diego Transportation Conformity Procedures may have a significant adverse effect on the environment and that this action is exempt from the provisions of the California Environmental Quality Act pursuant to California Code of Regulations, Title 14, Section 15061 (b) (3).
2. Direct the Air Pollution Control Officer to forward the adopted Resolution and the San Diego Transportation Conformity Procedures to the State Air Resources Board (ARB) for submittal to the Federal Environmental Protection Agency (EPA) as a revision to the State Implementation Plan (SIP) for San Diego County.
3. Direct the Air Pollution Control Officer to request ARB withdraw the previous SIP submittal containing Rule 1502 - Conformity of Transportation Plans, Programs, and Projects, and the associated MOA.
ON MOTION of Member Slater, seconded by Member Jacob, the Members of the Air Pollution Control Board closed the Hearing, took action as recommended, on Consent, adopting Resolution No. 98-198, entitled: REPEAL OF RULE 1502, TERMINATION OF THE ASSOCIATED MEMORANDUM OF AGREEMENT AND ADOPTION OF THE SAN DIEGO TRANSPORTATION CONFORMITY PROCEDURES.
