SAN 1. SUBJECT: Noticed Public Hearing:

Collection of Fiscal Year 1998-1999 Tax Roll of Existing Fees and Charges for the Alpine, Julian, Lakeside, Pine Valley and Spring Valley Sanitation Districts and the Winter Gardens Sewer Maintenance District; and Reimbursement-Property Lien Payments for the Lakeside Sanitation District

OVERVIEW:

In accordance with Section 5473 of the Health and Safety Code of the State of California, the Board amended the Uniform Sewerage Ordinance on February 17, 1998 (13). This Ordinance provides for the collection of sewer service charges on the tax rolls for the following Sanitation Districts: Alpine, Julian, Lakeside, Pine Valley, Spring Valley, and the Winter Gardens Sewer Maintenance District. The Ordinance also provides for the collection of reimbursement-property lien agreement payments on the tax roll for the Lakeside Sanitation District.

In all Districts, residential sewer service charges per Equivalent Dwelling Unit (EDU) for Fiscal year 1998-99 are the same as those collected for Fiscal Year 1997-98. The Commercial/Industrial sewer service charges in the Alpine, Lakeside, Spring Valley Sanitation Districts and the Winter Gardens Sewer Maintenance District are based on strength and flow, including Biochemical Oxygen Demand.

The action requested today will ensure that the payments for Fiscal Year 1998-1999 will be collected along with property taxes in the same manner they were during the last Fiscal Year, 1997-1998.

FISCAL IMPACT:

This action is consistent with the Board of Supervisors approval of Fiscal Year 1998-99 Sanitation and Sewer Maintenance District budgets. There will be no impact to the General Fund as a result of this action.

RECOMMENDATION:

CHIEF ADMINISTRATIVE OFFICER:

1. Conduct a public hearing to consider all objections and protests to the written tax roll reports for each sanitation district and sewer maintenance district which are on file with the Clerk of the Board of Supervisors.

2. Following the Public Hearing:

a. Adopt the Resolutions of the Alpine, Julian, Pine Valley, and Spring Valley Sanitation Districts, Sewer Service Charges for Fiscal Year 1998-99, to be collected on the tax roll.

b. Adopt the Resolution of the Lakeside Sanitation District, Sewer Service Charges and Reimbursement-Property Lien Agreement Payments for Fiscal Year 1998-99, to be collected on the tax roll.

ACTION:

ON MOTION of Director Slater, seconded by Director Horn, the Board of Directors of the Alpine, Julian, Lakeside, Pine Valley, and Spring Valley Sanitation Districts closed the hearing and took action as recommended, on Consent, adopting the following:

Resolution No. 98-205, entitled: RESOLUTION OF JULIAN SANITATION DISTRICT SEWER SERVICE CHARGES FOR FY 1998-99 TO BE COLLECTED ON THE TAX ROLL

Resolution No. 98-206, entitled: RESOLUTION OF PINE VALLEY SANITATION DISTRICT SEWER SERVICE CHARGES FOR FY 1998-99 TO BE COLLECTED ON THE TAX ROLL

Resolution No. 98-207, entitled: RESOLUTION OF SPRING VALLEY SANITATION DISTRICT SEWER SERVICE CHARGES FOR FY 1998-99 TO BE COLLECTED ON THE TAX ROLL

Resolution No. 98-208, entitled: RESOLUTION OF LAKESIDE SANITATION DISTRICT SEWER SERVICE CHARGES AND REIMBURSEMENT - PROPERTY LIEN AGREEMENT PAYMENTS FOR FY 1998-99 TO BE COLLECTED ON THE TAX ROLL
