REGULAR MEETING OF THE BOARD OF COMMISSIONERS
HOUSING AUTHORITY OF THE COUNTY OF SAN DIEGO
WEDNESDAY, SEPTEMBER 16, 1998

Meeting was called to order at 9:10 a.m.

1. SUBJECT: Section 504 Voluntary Compliance Agreement

OVERVIEW:

This action will formalize an agreement with the Federal Department of Housing and Urban Development that specifies the actions the Housing Authority will take to comply with federal requirements involving compliance with Section 504 of the Rehabilitation Act of 1973.

Section 504 provides that, no otherwise qualified handicapped individual in the United States shall, solely by reason of his handicap, be excluded from the participation in, be denied the benefits of, or be subjected to, discrimination under any program or activity receiving federal financial assistance. The Voluntary Compliance Agreement is the mechanism used by the Federal Department of Housing and Urban Development to ensure that recipients of federal funding for housing programs are not discriminating against handicapped persons.

FISCAL IMPACT:

If approved, this request will result in no current year costs, no annual cost and require the addition of no staff years.

RECOMMENDATION:

CHIEF ADMINISTRATIVE OFFICER/EXECUTIVE DIRECTOR:

Authorize the Deputy Director and the Chairman of the Housing Authority to sign the Voluntary Compliance Agreement with the Federal Department of Housing and Urban Development.

ACTION:

ON MOTION of Commissioner Slater, seconded by Commissioner Jacob, the Board of Commissioners of the San Diego County Housing Authority took action as recommended, on Consent.

2. SUBJECT: Mobile Home Issues Committee

OVERVIEW:

On June 9, 1998 (29), as recommended by Chairman Cox and Supervisor Jacob, the Board of Supervisors directed the Chief Administrative Officer and County Counsel to work with representatives of mobile home park owners and residents in the unincorporated area to develop an Ordinance creating a Mobile Home Issues Committee similar to those for the cities of El Cajon, Chula Vista and San Diego.

The following recommended actions will result in the adoption of an Ordinance that would create a County Mobile Home Issues Committee comprised of mobile home park owners and residents appointed by the Board of Supervisors. The Committee members would be equally divided between park owners and residents with a professional mediator serving as the chairperson. Although the Committee's actions would be advisory only and not binding on the parties, it is anticipated that the majority of issues would be resolved to everyone's mutual satisfaction.

FISCAL IMPACT:

Funds for this request are budgeted. The funding source is Housing Authority Earned Section 8 Administrative Fees. If approved, this request will result in $20,000 current fiscal year cost, $40,000 annual cost and will require the addition of no staff years. As the contract for mediation services will likely not be awarded until January 1999, an estimated $20,000 will be spent for mediation services in the last six months of the fiscal year ending on June 30, 1999.

BUSINESS IMPACT STATEMENT:

This proposal will have a positive impact on the business community by providing mobile home park owners with a mediation procedure to resolve landlord/tenant disputes and improve customer relations with mobile home park residents in the unincorporated area.

RECOMMENDATION:

CHIEF ADMINISTRATIVE OFFICER/EXECUTIVE DIRECTOR:

Authorize expenditures of up to $40,000 from Housing Authority Earned Section 8 Administrative Fees to pay for professional mediator services for the Mobile Home Issues Committee.

ON MOTION of Commissioner Slater, seconded by Commissioner Jacob, the Board of Commissioners of the San Diego County Housing Authority took action as recommended, on Consent.
