Meeting was called to order at 9:07 a.m.

ACTION:

ON MOTION of Director Cox, seconded by Director Roberts, the Board of Directors approved the minutes for the meetings of April 14, 1999, and April 20, 1999.

San 1. SUBJECT: Temporary Connection Agreement Between Michael and Sara Hennessy and the Spring Valley Sanitation District

OVERVIEW:

This is a request for a Temporary Connection Agreement for property with a failed septic system.

FISCAL IMPACT:

Funds for this proposal are Temporary Connection Agreement fees. Approval of the Temporary Connection Agreement will allow the District to issue a wastewater discharge permit authorizing the collection of an annual sewer service charge. There will be no fiscal impact to the County General Fund as a result of this action.

RECOMMENDATION:

CHIEF ADMINISTRATIVE OFFICER:

1. Find, pursuant to Section 15301 (b) of the California Environmental Quality Act (CEQA) Guidelines, that this action is categorically exempt from provisions of the Guidelines as a minor alteration of the exterior plumbing of an existing structure.

2. Approve and authorize the execution of a Temporary Connection Agreement by the Clerk of the Board on behalf of the Spring Valley Sanitation District.

3. Direct the Clerk of the Board to transmit two executed copies of the Temporary Connection Agreement to the Executive Officer of the Local Agency Formation Commission of the County of San Diego.

SPRING VALLEY

San 2. SUBJECT: Advertise Spring Valley Outfall Sewer Liner (Manholes 15 to 16) in Spring Valley

(Supv. Dist: 1)

OVERVIEW:

This is a request for approval of the advertisement for bids of a project to line the sewer outfall in Spring Valley between manholes 15 and 16 which now has reduced structural integrity due to interior corrosion. Ensuring that the sewer line is intact will benefit the public health and safety of the residents in this community.

Following the bid opening, staff will return with a request for authority to award the construction contract to the lowest responsible and responsive bidder.

FISCAL IMPACT:

Advertising the project for construction in itself will have no fiscal impact. The construction cost of the project is estimated at $370,000 which will be completely funded by Spring Valley Sanitation District Funds.

A complete Fiscal Impact Statement will be included in the Board letter requesting authority to award the construction contract, subsequent to the bid opening.

RECOMMENDATION:

CHIEF ADMINISTRATIVE OFFICER:

1. Find in accordance with Section 15301 and 15304 of the California Environmental Quality Act Guidelines that this project is categorically exempt from the provisions of the Guidelines since it consists of the repair of an existing facility with minor alterations to the condition of land and will have no significant impacts to the environment or cause removal of mature scenic trees.

2. Approve the contract documents, including the plans and specifications.

3. Authorize the Deputy Director of Purchasing and Contracting Division of General Services to advertise the project for bids.

ALPINE, LAKESIDE, SPRING VALLEY

San 3. SUBJECT: Commercial/Industrial Permitting and Monitoring Divestiture in the Department of Public Works, Wastewater Management Section

OVERVIEW:

On March 17, 1998 (20) the Board directed the Chief Administrative Officer to investigate the possibility of divestiture of the commercial/industrial wastewater permitting and monitoring function within the Department of Public Works. The investigation determined that, through a combination of reengineering and contracting certain tasks to the City of San Diego (City), this function can be more economically performed. There are currently two full-time positions performing this function. As a result of the proposed improvements both positions will be eliminated.

Board action is requested to find that the commercial/industrial permitting and monitoring function can be more economically performed by a combination of one staff position and a contract with the City; to approve the award of the contract with the City; and to direct that the compensation ordinance be amended to delete two staff positions and add one position at a lower classification. The requested action will result in reduced cost, more efficient services, less interruption to businesses caused by non-critical inspections and Sanitation District Enterprise Fund savings that can be reinvested into the District's operations.

FISCAL IMPACT:

This proposal will result in no current year cost and a reduction of $133,484 in costs to the Wastewater Management Enterprise Fund over the four-year contract period. The requested action will also result in the net reduction of one staff year and there will be no impact to the County General Fund.

BUSINESS IMPACT STATEMENT:

One element of this proposal is revising inspection requirements to match the City's program. This will result in 1,450 fewer inspections per year, thereby reducing impacts and interruptions to business operators.

RECOMMENDATION:

CHIEF ADMINISTRATIVE OFFICER:

1. Find that this action is exempt from environmental review under the California Environmental Quality Act Guidelines Section 15301(b), because it consists of the operation of an existing public sewerage facility.

2. Find that it is more economical and efficient to contract with the City of San Diego to perform Commercial/Industrial permitting and monitoring function than by classified employees in the Wastewater Management Section.

3. Approve and authorize the Clerk of the Board to execute, upon receipt, amendments to agreements with the City to provide permitting and monitoring services over a four-year period for approximately $124,000.

4. Designate the Director of the Department of Public Works as the County Officer responsible for administering the contract.

5. Authorize the Director of the Department of Human Resources to amend the Compensation Ordinance by deleting two positions of Industrial Waste Control Representatives, and to appropriately classify one new position.

San 4. SUBJECT: Joint Exercise of Powers Agreement Between Metropolitan Sewerage System and Participating Agencies, Including Lakeside, Alpine, Spring Valley Sanitation Districts and Winter Gardens Sewer Maintenance District

OVERVIEW:

The Alpine, Lakeside, and Spring Valley Sanitation Districts, along with the Winter Gardens Sewer Maintenance District, contract with the City of San Diego for sewage treatment and disposal as Participating Agencies in the Metropolitan Sewerage System (Metro). The Metro Participating Agencies are proposing the formation of a Metro Sewer Public Financing Authority in order to provide bond financing capability to each Participating Agency for their share of Metro capital facilities, estimated to be $110 million over the next ten years ($18 million for County Sanitation Districts).

It is recommended that the County Sanitation Districts approve the Joint Exercise of Joint Powers Agreement (JPA) to form the Financing Authority. This action will give the County financial flexibility to use the Financing Authority to issue bonds on its behalf for its share of the Metro capital facilities, should the need arise. However, since the County Sanitation Districts do not currently need to finance their share of the Metro capital costs, it is not recommended that the County Sanitation Districts participate in the initial bond offering.

The JPA will also assume the role of Agencies For Fair & Objective Rate Decisions (AFFORD) of which the County Sanitation Districts are a member. Joining the JPA will enable the County to continue to work with the other Participating Agencies in providing oversight of the City of San Diego's operation of Metro.

FISCAL IMPACT:

Funds for this request are available in the Alpine, Lakeside and Spring Valley Sanitation Districts and Winter Gardens Sewer Maintenance District Fund/Balances. If approved, the annual costs will be limited to a fair share of the Financing Authority's administrative expenses not related to bond sales. This administrative expense is anticipated to be the same as the current obligation of approximately $26,000 annually for AFFORD administrative costs. The County will not be responsible for any bond financing. This request will require no additional staff years and will have no impact on the General Fund.

RECOMMENDATION:

CHIEF ADMINISTRATIVE OFFICER:

1. Find that this action is exempt from environmental review under the California Environmental Quality Act Guidelines Section 15061(b)(3) because there is no possibility that the activity in question may have a significant impact on the environment.

2. Approve and authorize the Clerk of the Board to execute, upon receipt, the Joint Exercise of Power Agreement to form the Metro Sewer Public Financing Authority on behalf of Alpine Sanitation District, Lakeside Sanitation District, Spring Valley Sanitation District, and Wintergardens Sewer Maintenance District.

3. Direct the Chief Administrative Officer to not participate in the Financing Authority's initial bond offering.
