Meeting was called to order at 9:02 a.m.

Approval of Statement of Proceedings/Minutes for meeting of November 15, 2000.

ACTION:

ON MOTION of Director Slater, seconded by Director Horn, the Board of Directors of the San Diego County Flood Control District approved the Statement of Proceedings/Minutes for the meeting of November 15, 2000.

OVERVIEW:

On September 11, 2000, the Del Mar City Council voted unanimously to approve emergency dredging of the San Dieguito Lagoon to avert an ecological disaster. Emergency action was necessary because a large sand berm had formed at the mouth of the San Dieguito River, closing the lagoon to vital tidal flushing. The lagoon experienced loss of small sea life and a major fish kill. Extensive algae mass and low water oxygen levels were prime conditions for a botulism outbreak. 

Excavation of a 40-foot channel at the river mouth restored tidal flushing to the lagoon, stimulating oxygen levels necessary to support life. This action assisted in preventing destruction of the lagoon and its biological species, and provided overall benefits to the health, safety and welfare of citizens of the region.

The City has requested assistance from local agencies to pay for the $108,000 emergency dredging project. Requested actions include establishment of appropriations and approval of an agreement to authorize payment of $25,000 from the flood control district to the City of Del Mar to assist with costs of dredging the San Dieguito Lagoon. The agreement is for a one-time payment, and includes language to protect the County from any future lawsuits or actions that may result from the project.

FISCAL IMPACT:

Funds for this proposal are not budgeted. Funding source is unappropriated Flood Control District fund balance. If approved, this request will result in $25,000 current year cost, no annual cost and will require no additional staff years.

RECOMMENDATION:

CHIEF ADMINISTRATIVE OFFICER:

1.          Find that the following action is not subject to California Environmental Quality Act (CEQA) under Section 15061(b)(1) of CEQA Guidelines, because it is not a project as defined in Section 15378.

2.                  Establish appropriations of $25,000 in the Department of Public Works Org 8807, Acct 3453, Task 111 and Activity FC4003 to help pay dredging of San Dieguito Lagoon based on fund balance available in the Flood Control District fund.

3.                  Approve and authorize the Clerk of the Board to execute, upon receipt, two originals of an agreement between the County of San Diego and City of Del Mar to contribute $25,000 toward emergency dredging of San Dieguito Lagoon.

            ACTION:

ON MOTION of Director Slater, seconded by Director Horn, the Board of Directors of the San Diego County Flood Control District took action as recommended, on Consent.

FLD2SUBJECT:     VACATION OF FLOWAGE EASEMENT - PORTION OF PARCEL 2 OF PARCEL MAP NO. 8022 -  ARIANA LANE, JAMUL

OVERVIEW:

This is a request to vacate a flowage easement encumbering residential property on Ariana Lane in Jamul.  County staff has determined that the area affected by this proposed easement vacation is not required by the County for flowage purposes.  This action will allow the owner to obtain clear title to this portion of his property.

FISCAL IMPACT:

There is no fiscal impact associated with this request.

BUSINESS IMPACT STATEMENT:

There is no business impact associated with this action, as all construction is complete on this property.

RECOMMENDATION:

CHIEF ADMINISTRATIVE OFFICER:

1.         Find, in accordance with Section 15061 (b) (3) of the State of California Environmental Quality Act Guidelines, that it can be seen with certainty that there is no possibility that the following action will have a significant effect on the environment.

2.            Adopt the Resolution Vacating and Abandoning Flowage Easement encumbering Assessor Parcel No. 596-024-15.

3.            Direct the Clerk of the Board to record the Resolution Vacating and Abandoning Flowage Easement.

ACTION:

ON MOTION of Director Slater, seconded by Director Horn, the Board of Directors of the San Diego County Flood Control District took action as recommended, on Consent, adopting Resolution No. 00-425, entitled: RESOLUTION VACATING AND ABANDONING FLOWAGE EASEMENT.
