SUBJECT:

APPLICATION FOR A CALIFORNIA HOUSING FINANCE
AGENCY HOUSING ENABLED BY LOCAL PARTNERSHIPS 
LOAN

 

OVERVIEW:

 

These actions will allow the Deputy Director of the Housing Authority of the County of San Diego to apply for a loan of up to $1,000,000 from the California Housing Finance Agency to aid with the financing of the Village West affordable housing project, a 96-unit apartment complex in the community of Fallbrook for low-income families. 

Repayment of the California Housing Finance Agency funds will be secured by a Promissory Note and a Recorded Deed of Trust between Southern California Housing Development Corporation and the Housing Authority.  Southern California Housing Development Corporation has committed to annual payments to a reserve fund that will be used to assist with the CHFA loan payback.  In addition, the difference between the reserve fund balance and the CHFA loan payback will be guaranteed by SCHDC through a Bank Letter of Credit.

 

FISCAL IMPACT:

 

There is no current year fiscal impact for the CHFA HELP loan request. Funds for the CHFA HELP loan request will be recommended for inclusion in the proposed FY 2001/2002 Housing Authority budget and will result in up to $1,000,000 in revenue and expenditures.  There is neither General Fund costs nor additional staff years.

 

RECOMMENDATION:

 

EXECUTIVE DIRECTOR/CHIEF ADMINISTRATIVE OFFICER 

1.                  Authorize the Deputy Director of the Housing Authority of the County of San Diego to apply to the State of California, execute loan agreements, incur indebtedness of up to $1,000,000, commit specific local government agency resources, and take other actions necessary to facilitate the acquisition of the Village West Apartments Project on behalf of Southern California Housing Development Corporation for the California Housing Finance Agency (CHFA) Housing Enabled by Local Partnerships (HELP) loan.

2.                  Authorize the Deputy Director of Housing Authority of the County of San Diego to accept the State of California, California Housing Finance Agency Loan award for the Housing Enabled by Local Partnerships (HELP) Program, in the amount of up to $1,000,000.

3.                  Authorize the Deputy Director of the Housing Authority of the County of San Diego to negotiate and execute, with County Counsel concurrence, all contracts and/or amendments within 12 months of your approval, and to take all necessary actions for the submittal and/or regulatory processing for the implementation of the above projects, with the Deputy Director’s discretion to extend the commitment to 15 months.

HA 2.

SUBJECT:

PROPERTY MANAGEMENT FOR HOUSING AUTHORITY OWNED PROPERTIES

 

OVERVIEW:

 

The requested actions will authorize the Director of the Department of Purchasing and Contracting to issue a Request for Proposals and award a contract for property management services for Housing Authority owned properties. 

Currently, the Housing Authority partners with private industry property management firms to provide day-to-day management and operation of Housing Authority owned properties. The current contract will expire on June 30, 2001.  The benefits to the County entering into a private sector partnership include a streamlined approach, smaller government and economic stimulation. 

The responsibilities of the property management company include conducting tenant eligibility interviews, maintaining tenant occupancy, collecting rents, performing annual unit inspections, maintaining grounds and common areas, and responding to routine emergency problems associated with the management and operation of all rental properties.

 

FISCAL IMPACT:

 

Funds for this request are budgeted.  All costs are offset by rents received from the tenants or subsidies received from the United States Department of Agriculture.  The United States Department of Agriculture provides a subsidy to Firebird Manor farmworker housing.  These revenues will offset all direct costs as well as the departmental administrative costs.  There is no impact to the County General Fund.  If approved, this request will result in $245,518 annual cost and will require the addition of no staff years.

 

RECOMMENDATION:

 

EXECUTIVE DIRECTOR/CHIEF ADMINISTRATIVE OFFICER

1.      In accordance with Section 401 of Article XXIII of the County Administrative Code, authorize the Acting Director of the Department of Purchasing and Contracting to issue a Request for Proposal to procure property management services for Housing Authority owned properties; and upon successful negotiations, award a contract through June 30, 2002, with up to four one-year options; and to amend any awarded contract as required to reflect changes to service and funding allocations, subject to the approval of the Director, Housing Authority of the County of San Diego.

HA 3.

SUBJECT:

USE OF SURPLUS PUBLIC HOUSING DEVELOPMENT FUNDS FOR MODERNIZATION AND OPERATIONS

 

OVERVIEW:

 

This is to request that the Board of Commissioners approve the use of surplus public housing development funds in the amount of $919,793 for public housing modernization (i.e., capital improvements) and ongoing public housing operations.

From 1981 to 1995, the Housing Authority constructed four public housing development projects in the City of Chula Vista. These projects provide affordable rental housing for very-low income families and senior citizens. There was a balance of  $919,793 in surplus development funds remaining when these projects were completed.

To ensure the continued high quality and efficient operations of these public housing projects, it is recommended that the surplus development funds be used for funding comprehensive modernization/capital improvements of the public housing projects and for funding the ongoing operations of the public housing program.

The U.S. Department of Housing and Urban Development’s (HUD) procedure for the use of development funds for modernization requires that the Housing Authority submit: (1) A Board of Commissioners’ Resolution approving the use of the surplus development funds for public housing modernization and operations; and (2) Revised Development Cost Budgets/Cost Statements showing that the surplus development funds are being used for public housing modernization and operations.

 

FISCAL IMPACT:

 

Funds for this request are budgeted. The funding source is the U.S. Department of Housing and Urban Development (HUD). If approved, this request will result in $375,563 in the current fiscal year for public housing operations, $544,230 in the subsequent fiscal year for public housing modernization/capital improvements and will require the addition of no staff years.

 

RECOMMENDATION:

 

EXECUTIVE DIRECTOR/CHIEF ADMINISTRATIVE OFFICER 

1. Adopt the attached Resolution approving the use of surplus public housing development funds in the amount of $919,793 for modernization and operations of the Housing Authority’s public housing projects located in the City of Chula Vista.

2. Authorize the Deputy Director of the Housing Authority to plan and execute Development Cost Budgets/Cost Statements showing that the surplus public housing development funds are being used for public housing modernization activities and for ongoing public housing program operations.

3. Authorize the Deputy Director of the Housing Authority to take any and all actions necessary and appropriate to carry out the intent and purpose of the attached Resolution including, but not limited to, obtaining the services of architects/engineers to prepare plans and specifications for public housing modernization/capital improvements and soliciting, negotiating and awarding contracts for public housing modernization/capital improvements.

ON MOTION of Commissioner Mitchell, seconded by Commissioner Roberts, the Board of Commissioners of the San Diego Housing Authority took action as recommended, on Consent, adopting Resolution No. 01-86 entitled:  RESOLUTION AUTHORIZING AND APPROVING THE USE OF PUBLIC HOUSING DEVELOPMENT FUNDS FOR MODERNIZATION AND OPERATIONS.

HA 4.

SUBJECT:

PUBLIC HOUSING AGENCY FIVE-YEAR PLAN FOR FY 2001-2005/ANNUAL PLAN FOR FY 2001; PUBLIC HOUSING ADMISSIONS AND CONTINUED OCCUPANCY POLICY; AND SECTION 8 ADMINISTRATIVE PLAN

 

OVERVIEW:

 

The recommended actions will: 1) Approve the Public Housing Five-Year Plan for FY 2001-2005/Annual Plan for FY 2001; Public Housing Admissions and Continued Occupancy Policy; and the Section 8 Administrative Plan for the Housing Authority of the County of San Diego; and 2) Authorize the Deputy Director of the Housing Authority of the County of San Diego to execute all necessary certifications and amendments necessary for submittal to the U.S. Department of Housing and Urban Development.

The U.S. Department of Housing and Urban Development (HUD), in response to the Quality Housing and Work Responsibility Act of 1998 (QHWRA), requires housing authorities to prepare a Public Housing Agency Plan and adopt supporting policy documents that describe discretionary policies and procedures for the conduct and administration of the Public Housing and Section 8 Programs.  The Plan is similar to the consolidated plans that local jurisdictions (which use federal funds for housing and community development programs) prepare for HUD.  The Agency Plan and supportive policy documents are a source by which public housing residents, participants of the rental assistance program, and other members of the public may locate basic Housing Authority policies, rules and requirements concerning its operations, programs and services.

 

FISCAL IMPACT:

 

There is no fiscal impact to this request.  This request will result in no current year costs, no annual costs and will require the addition of no staff years.

 

RECOMMENDATION:

 

1.  Approve and authorize the submittal of the Public Housing Five-Year Plan for FY 2001-2005/Annual Plan for FY 2001; Public Housing Admissions and Continued Occupancy Policy; and the Section 8 Administrative Plan to the U. S. Department of Housing and Urban Development (HUD).

2.  Authorize the Deputy Director of the Housing Authority of the County of San Diego, in consultation with County Counsel to execute all necessary certifications, amendments or take any necessary actions required by HUD for acceptance and submittal of the Public Housing Agency Plans.
