SUMMARY OF ORDINANCE: The project is a proposed amendment to the San Diego County Zoning Ordinance to introduce a new winery classification, Boutique Winery. Under the proposed amendment, the "Packing and Processing: Boutique Winery" Use Type would be allowed subject to limitations in the A70-Limited Agriculture and the A72- General Agriculture Use Regulations. The Boutique Winery Use Type can produce up to 12,000 gallons of wine per year and may include a tasting room and retail outlet as secondary uses pursuant to an Administrative Permit with specified Findings. PROJECT DESCRIPTION: Since the October 19, 2004 adoption of the HMP by the Board of Supervisors, the State Legislature approved Assembly Bill (AB) 2140 adding Sections 8685.9 and 65302.6 to the Government Code. This authorizes a city and county to adopt with its Safety Element a federally specified local hazard mitigation plan. It also proposes penalties on local jurisdictions that have not adopted a local hazard mitigation plan as part of the Safety Element. This amendment is intended to bring the County into compliance with the Government Code.

NOTICE OF PUBLIC HEARING

NOTICE, pursuant to the State of California Health and Safety Code Section 40725, is hereby given of a public hearing on May 14, 2008, at 9:00 a.m., before the Air Pollution Control Board of the County of San Diego, in Room 310, County Administration Center, 1600 Pacific Highway, San Diego, California, for the purpose of receiving public comments on and considering amendments to Rule 67.21 – Adhesive Materials Application Operations.

Rule 67.21 regulates emissions of volatile organic compounds (VOC) from the application of adhesives, sealants, and adhesive and sealant primers. The proposed amendments will provide lower VOC content limits for some architectural, specialty adhesive materials and substrate-specific adhesive materials. The limits will be reduced for flooring, multipurpose construction and structural wood member adhesives, contact adhesives, and adhesives applied on porous materials, including wood. Proposed amended Rule 67.21 will also: specify that its requirements no longer apply to aerosol adhesives, which are now covered under the Air Resources Board Consumer Products regulation; include several new definitions for adhesive materials; and update test methods. In addition, the rule will clarify that facilities can annually use less than 55 gallons of non-compliant adhesive materials, but that this low-use exemption from the VOC content limits does not apply to the associated clean-up, stripping, or surface preparation solvents, or adhesive bonding agents.

The Board may consider modifications to the proposal, which may be deemed appropriate. Written comments concerning the proposal are also invited. Please submit written comments at least one week before the hearing date, addressed to:

NOTICE OF PUBLIC HEARING

NOTICE, pursuant to the State of California Health and Safety Code Section 40725, is hereby given of a public hearing on March 26, 2008, at 9:00 a.m., before the Air Pollution Control Board of the County of San Diego, in Room 310, County Administration Center, 1600 Pacific Highway, San Diego, California, for the purpose of receiving public comments on and considering amendments to Rule 61.4 – Transfer of Volatile Organic Compounds into Vehicle Fuel Tanks and Rule 61.4.1 – Transfer of Gasoline from Stationary Underground Storage Tanks into Vehicle Fuel Tanks.

Rule 61.4 regulates emissions during the transfer of volatile organic compounds (VOC) from stationary underground and aboveground storage tanks into vehicle fuel tanks. The rule implements federal requirements and is included in the State Implementation Plan (SIP). Rule 61.4 requires gasoline dispensing facilities to be equipped with California Air Resources Board certified vapor recovery (VR) systems that reduce VOC emissions during vehicles refueling. Further, pursuant to state requirements, the District adopted Rule 61.4.1 that regulates the transfer of gasoline from stationary underground storage tanks into vehicle fuel tanks. This rule requires gasoline dispensing facilities to install and maintain certified Enhanced Vapor Recovery (EVR) systems that further reduce VOC emissions.

The proposed amendments will provide an exemption from the VR (Rule 61.4) or EVR (Rule 61.4.1) requirements, as applicable, to non-retail facilities where at least 95% of vehicles refueled are equipped with Onboard Refueling Vapor Recovery (ORVR). Both rules will also provide the same exemption for facilities that refuel Flexible Fuel vehicles operating on E-85 (gasoline-ethanol blend) that are already equipped with ORVR. All model year 2000 and newer passenger cars are ORVR-equipped, as are all model year 2003 and newer, light duty trucks, sport utility and similar vehicles, and all model year 2006 medium- and heavy-duty trucks. It is expected that the VOC emission reduction efficiency of the ORVR systems is at least as high as that of the EVR systems. Federal EPA guidance allows removing Phase II vapor recovery systems at gasoline dispensing facilities where it was determined that at least 95% of all vehicles refueled at the facility are ORVR-equipped. The California Air Resources Board concurs with this guidance.

Rule 61.4 will also be updated to include emission testing, recordkeeping requirements, and test methods to correct deficiencies identified by the federal EPA and delete outdated provisions. The amended Rule 61.4 will be submitted to EPA as a SIP revision.

PROJECT DESCRIPTION: This is an appeal of the denial by the Planning Commission of a revised Tentative Map 5269R for 14 residential lots and associated Density Bonus Project DBP 06-001. Tentative Map 5269 was approved by the County Planning and Environmental Review Board on March 4, 2004 as a subdivision for nine (9) single-family residences on a 2.59-acre parcel. The applicant proposes to revise the Tentative Map to increase the number of single-family lots to 14, based on Density Bonus incentives pursuant to Section 65915 of the Government Code. Staff recommends approval of a 13-lot density bonus project. The project area is subject to the (6) Residential land Use Designation (7.3 dwelling units per gross acre) and the RS4 Single-Family Residential (4.3 dwelling units per net acre) Land Use Regulation. However, with the Density Bonus Project, and pursuant to State Government Code 65915, the applicant is allowed an increase in density, along with potential incentives to encourage the development of affordable housing.<
