The County of San Diego has limitations on Brushing and Clearing completed on any given parcel located within the Unincorporated Areas of San Diego County.

The purpose of the brushing and clearing ordinance is to eliminate grading/clearing that destroys environmental resources, and threatened and endangered species and habitats.

Our Frequently Asked Questions for Brushing & Clearing are intended to provide some guidance as to when permits are required prior to brushing and clearing of property.

MSCP PERMIT GUIDE – BRUSHING & CLEARING OF LAND

The MSCP provides for exemptions from the County Regulations for brushing and clearing of land under the following circumstances:

Brushing and Clearing on existing parcels ten acres and under in size containing a dwelling unit as of Oct 22, 1997.

Agriculturally related clearing within the MSCP, provided that such clearing meets certain requirements and does not cumulatively exceed 3,000 acres for San Diego County.

Parcels ten acres and under in size, zoned for single-family residential uses (without dwelling unit), shall be allowed to clear up to two acres when they are located within the Pre-approved Mitigation Area of the MSCP, and up to five acres if they are located outside the Pre-approved Mitigation Area.

These grading and clearing allowances are subject to additional criteria. To determine whether your property is located within the Pre-approved Mitigation Area of the MSCP and more detail on the criteria that must be met for these exemptions, please call the Department of Planning and Land Use Zoning Counter at (858) 565-5981.

To document your exemption from the Grading and Clearing Ordinance requirements you may obtain a Certificate of Inclusion. The procedures for obtaining a certificate are shown below.

Provide Assessor Parcel Number (APN), Address, Thomas Brothers Page, or nearest cross streets.

Once property is located in the MSCP database the staff will ask questions pertaining to property and proposed activity.

Preliminary determination will be made whether a Certificate can be issued.

The office will provide information on what will be needed to obtain a Certificate.

Make an appointment to pick up the Certificate.
