Occasionally, amendments must be made to Department of Planning and Land Use Ordinances

and Policies to address recently discovered errors, address new state statutes, add new uses

or directives and/or to add clarification language to address interpretation issues.

Topic:
Tiered Winery Ordinance, POD 08-012

Summary: 
The Ordinance would allow, among other uses, Boutique Wineries by-right in Agricultural Zones. The Board of Supervisors directed the preparation of an Environmental Impact Report to analyze the impacts of the tiered winery ordinance.

Topic:

Zoning Ordinance Amendments, POD 08-011

Summary:
The proposed amendments are clean-ups and revisions that will be limited to items that are minor in scale, are intended to clarify regulations, correct minor errors in text, or address new, modern issues that are not controversial.

Topic:
Noise Ordinance Amendment, POD 08-009


Summary:

The proposed amendments to the County Noise Ordinance are part of a comprehensive update of Title 3 of the County Code of Regulatory Ordinances being conducted by the Office of County Counsel with the assistance of County Departments. The proposed Noise Ordinance amendments consist of a thorough update to the Ordinance which will help to clarify regulations, improve readability and upgrade enforcement components available in the ordinance. Some changes and additions that may be of particular interest include: clarification of noise limitations within specific plan areas (Sec. 36.404(c)), clarification of construction noise limitations (Sec. 36.409), add an inclusion of sections pertaining to impulsive noises sources (Sec. 36.410) and regulation of noise from off-road recreational vehicles (36.416).

Status:
Environmental Review of Negative Declaration completed. Proposed Noise Ordinance Amendment will be scheduled for the October 17, 2008 Planning Commission hearing.

Topic:
Board Policy I-63 Sunset Review, POD 08-008



Summary:

 

Policy I-63 establishes guidelines for processing proposed amendments to the County General Plan requiring that amendments to County General plan to only be undertaken when authorized by the Board of Supervisors, the Planning Commission, or the Planning Director.  Currently pursuant to Policy I-63, once a General Plan Authorization is initiated by the applicable County decision-maker, no time period is provided as to when an applicant can file a General Plan Amendment.  Consequently, General Plan Amendments are being filed based on Plan Amendment Authorizations that may have been initiated many years prior.  This has resulted in General Plan Amendments going forward based on antiquated information and analysis that may no longer be applicable and would no longer be supported by a new Plan Amendment Authorization review.

Revision to Board Policy I-63 would include; (1) a provision to the Policy that Plan Amendment Authorizations would expire 2 years from the date of the decision makers initiation of the Plan Amendment, (2) a requirement that in circumstances when a Plan Amendment Authorization has not been approved by the applicable decision maker, the requestor file a request to the next applicable decision making body within 10 days; and (3) that already initiated Plan Amendment Authorizations which have not formally filed a General Plan Amendment application with the Department of Planning and Land Use expire one year after the adoption of this revised Policy.

Subdivision Ordinance Update, POD 08-006

Summary:

 

This Policy and Ordinance Development project (POD 08-006) is to update the County of San Diego's Subdivision Ordinance (Title 8, Division 1 of the County of San Diego Regulatory Ordinances ) and Zoning Ordinance.  These Ordinance Amendments will include the following changes:

Repeal Expired Tentative Map and Expired Tentative Parcel Map provisions to bring the County of San Diego Subdivision Ordinance into compliance with the Subdivision Map Act.

Amend the Subdivision Ordinance to clarify the regulations regarding the design of subdivisions.

Amend the Subdivision Ordinance regarding implementation of mitigation and on-going conditions, to establish Site Implementation Requirements. 

Amend the Zoning Ordinance to establish the Site Implementation Requirement regulations.

Topic:
Second Dwelling Unit/Guest Quarters, POD 08-005

Summary:

 

Currently, the County Zoning Ordinance Section 6156 identifies four types of accessory dwelling units: Second Dwelling Unit, Accessory Apartment, Accessory Living Quarters and Guest Living Quarters.  The allowances and limitations for each category overlap often causing confusion for our customers.

To simplify the use regulations, DPLU is proposing to reduce the number of accessory dwellings into two types: Second Dwelling Units and Guest Living Quarters.  In short, a Second Dwelling Unit has all the accommodations as the primary structure with certain limitations such as structure size while the Guest Living Quarters is designed for the temporary use by guests or people employed on the premises.  Guest Living Quarters do not have kitchen facilities or laundry facilities.  Most other jurisdictions only have these two types of dwelling units.

Parking Design Manual, POD 08-004

Summary:
This project is to update the Parking Design Manuel, Zoning Ordinance, Departmental Policies and Departmental Forms with regard to Parking Regulations. The update is needed because it has been more than 20 years since the manual has been updated and there have been changes to parking design and parking requirements locally and nationally.
