Wireless Leasing Opportunities

The County of San Diego, Real Estate Services (RES) provides One Stop Service for negotiating and drafting leases for wireless cell facilities that are constructed on County owned property. RES welcomes the opportunity to negotiate with Wireless Carriers and their designated Acquisition Agents, lease agreements. RES will provide project milestones which include coordinating the initial site walk to scheduling final construction walk through. RES will provide direct support with drafting and executing a revenue agreement, provide landlord design review, issue land use permit Letters Of Authorization (LOA), provide County Tax ID's, coordinate Construction Management, and manage site modifications.

RES is committed to providing a full range of services that are designed to reduce the approval time frame for executing a wireless lease agreement. RES has contracted with Locke Management Group, Inc., who is designated as the Real Estate Services Agent responsible for providing a full array of site acquisition services that include;

• Coordinating Site Visits with Carriers and their designated site acquisition agents
• Providing Land Use 'Letters of Authorization'
• Reviewing proposed design concepts
• Coordinating county client departmental approval
• Obtaining a fair market valuation for each proposal
• Negotiating co-location terms and agreements
• Drafting Lease and License Agreement, Lease Amendments and Right of Entry Permits
• Providing status to the Carrier and Site Acquisition Agents of the proposed milestone time line of approval of their respective project
• Provide a substitute W-9 County Tax ID.
• Coordinating all site modifications
• Process and Guidelines for Submitting a Proposal to the County

After the carriers network architect has identified a County site as a candidate for a potential wireless facility, direct contact will be made with Locke Management Group, Inc who will coordinate a site walk with the carrier. Please see the contact information below. If the carrier has determined that the County facility site is a suitable location for a wireless facility and the carrier wishes execute a revenue agreement with the County, then two Non Refundable Deposits will be submitted. The deposits are:

A Five Thousand dollars ($5,000) for a single site or Ten Thousand dollar ($10,000) for a multi site repeater project, made payable to the "Locke Management Group, Inc." and delivered to the following address:

The deposit will fund a fair market value analysis as well as the County staff coordination required to draft and execute a lease or revenue agreement .

All leases that require a renewal must provide funds in the amount of $5,000.

The deposit for a lease amendment will vary between $2,000 to $5,000 depending on the complexity of the agreement. A Right of Entry Permit will require a deposit in the amount of $2,500 made payable to Locke Management Group, Inc.

A Design and Construction Management deposit is required for all proposals submitted to the County. The Design and Construction Management deposits are to be made payable to "County of San Diego" and delivered to the following address:

The Design and Construction Management deposits will vary in the amount of $3,500 to $10,000, depending on the complexity of the design of the project and the type of construction required to complete the project. The deposit will fund a preliminary and a revised construction design review, three separate, three-hour on-site construction management meetings and eight hours of on-site code compliance inspections.

All deposits are nonrefundable, do not guarantee approval and the deposits cannot be applied to any future lease payments. If the scope of the project exceeds the deposit estimate then additional funding will be required from the carrier.

Site Modifications

All proposed cell site modifications will require review and approval by the County of San Diego. All proposed modifications request will be submitted to Real Estate Services Division, attn Greg Locke. Each proposal will require a detailed description and scope of the proposed modification. If the modification either: 1) Expands the existing premise, or 2) Is deemed by the County to have a potential impact to the County facility or its tenants, then two deposits will be required. The deposits will provide for project review and execution of a lease amendment. Based on the modification requested, the deposits will be payable to either:

1. Locke Management Group for the administrative processing and

2. The County of San Diego for design review and construction management.

Depending on the complexity and scope of the proposed modification the deposits can range from $2,500 to $5000 for the administrative processing and $1500 to $5000 for design review and construction management.

County Regional Centers and Security Sensitive Facilities

The County of San Diego maintains security sensitive Regional Center Facilities which due to their geographic location and height have a number of operational cell sites. All proposed site modification at any of the County Regional Centers or other security sensitive sites will require a minimum deposit of $1000 for project review.

Access to Each Regional Center and Security Sensitive Facilities - All Carriers, their site acquisition agents and authorized sub contractors are required to obtain, in advance, security access badges. The application period for obtaining an access badge is 2-4 weeks. Security access badge applications can be obtained by contacting;

The lack of security access badges will result in denial of access to any of the County Regional Centers or other security sensitive facilities.

Land Use Permit Approval

The deposits made payable to Locke Management Group, Inc and to the County for Design and Construction Management, are separate from and does not apply to any applicable land use permit approval costs or other land use approval requirements, studies or inspections. The lease revenue process is separate and independent from the Land Use permit approval process. Locke Management Group, Inc will provide the Carrier Site Acquisition Agent with a Land Use Permit Letter of Authorization which provides approval for the carrier to submit a land use permit application. Wireless Lease Agreements

The County Real Estate Services Division will draft and provide each respective carriers with a County approved lease and revenue contract. The County does not maintain a Master Lease Agreement rather, the County tailors each lease and revenue agreement to the specific needs and requirements of each County client department. The Director of General Services is given authority to execute leases based on the provision contained in County Administrative Code 73.10. All Real Estate Services lease agreements will be for a term of ten years with no options to extend, will have an annual COLA adjustment, will require annual site inspections that will be funded by the carrier. The County lease agreement contains 20 Articles, a lease premise and on insurance exhibit.
