Background Information
Senate Bill (SB) 621, which became law on January 1, 2004, established Indian Gaming Local Community Benefit Committees (IGLCBC); made grant funding available to counties, cities and special districts impacted by tribal gaming from the Indian Gaming Special Distribution Fund (SDF); and set the rules for eligibility and purposes of the grants. Those gaming tribes who operated 200 or more gaming devices on or before September 1, 1999 contribute a variable portion of their net winnings into the Fund. In San Diego County , these tribes were the Barona Band of Mission Indians (Barona); Sycuan Band of the Kumeyaay Nation (Sycuan); and the Viejas Band of Kumeyaay Indians (Viejas). The latest compacts with Governor Schwarzenegger have eliminated contributions to the Special Distribution Fund. The Viejas Band has signed an Amended Compact with the Governor and no longer contributes to the SDF.
The primary purpose of this committee is to select the local jurisdiction grants to be funded from the Tribal Gaming Casino Account. The committee also has the following responsibilities:
- Establish all application policies and procedures for grants from the Individual Tribal Casino Accounts of County Tribal Casino Account.
- Assess the eligibility of applications for grants from local jurisdictions impacted by tribal gaming operations.
- Determine the appropriate amount for reimbursement from the aggregate county tribal account of the demonstrated costs incurred by the county for administering the grant programs.
Assembly Bill (AB) 675, which became law on September 29, 2004, amended SB 621's provision regarding the composition of the IGLCBC for San Diego County only. AB 675 provides that in San Diego County , the IGLCBC is to be composed of the following members:
- Two representatives from the county, selected by the County Board of Supervisors;
- One elected representative from the city located within four miles of a tribal casino in the county, selected by the County Board of Supervisors;
- Three representatives selected upon the recommendation of a majority of the tribes paying into the Indian Gaming Special Distribution Fund in the County; and
- The Sheriff of San Diego County
On January 12, 2005, the County Board of Supervisors appointed Supervisor Dianne Jacob and Greg Smith, Assessor, Recorder and County Clerk , as the two representatives from the County, and Mayor Mark Lewis of the City of El Cajon. Barona appointed Council Member Edwin Romero; Sycuan appointed Chairman Daniel Tucker; and Viejas appointed Council Member Alan Barrett to the Committee. In addition, Sheriff Bill Kolender is a member of the Committee. The Bylaws of the San Diego IGLCBC state that the term of office for the members is four (4) years.
Since Viejas stopped contributing to the SDF when they amended their gaming compact, only two tribes remain members of the IGLCBC - Barona and Sycuan. On December 14, 2006, the Committee recognized Barona's appointment of Rhonda "Lisa" Welch-Scalco as one of the Tribal Representatives and Sheilla Alvarez as her Alternate, and Undersheriff William Gore as Alternate for Sheriff Kolender. In October 2007, Chairman Daniel Tucker resigned from the Committee and Sycuan appointed Adam Day as his replacement.
In his FY 07-08 budget, the Governor did not allocate any money to the County's Tribal Casino Account therefore no grants were available in FY 07-08 and the Committee did not meet.
